Welcome to Luxury Machu Picchu. We pride ourselves on delivering flawlessly executed, bespoke private travel experiences across Peru. To maintain our rigorous standards of service and ensure mutual clarity, we ask all clients to review and accept the following Terms and Conditions (alongside our Privacy Policy) prior to confirming their itinerary. By rendering a deposit, you formally agree to these protocols.

1. Bespoke Itinerary Design & Booking Protocols

Because each journey we craft is customized around your dates and preferences, securing 3, 4, and 5-star accommodations, expert private guides, and exclusive experiences—such as the Belmond Hiram Bingham train or luxury Amazon cruises—requires advance planning and immediate financial commitments to our partners.

• Deposit: A non-refundable deposit of 40% of the total itinerary cost is required to secure your reservations. Due to high demand for luxury services and government permits in Peru, bookings cannot be guaranteed until this deposit is received and cleared alongside passenger passport details.
• Final Payment: The remaining 60% balance must be settled no later than 60 days prior to your arrival date. For bookings confirmed within 60 days of travel, full payment is required immediately upon confirmation.

2. Cancellation and Refund Policies

We understand that unforeseen circumstances may alter your travel plans. However, because our bespoke itineraries involve strict, non-refundable commitments to third-party suppliers (luxury hotels, private rail services, domestic airlines, and nominal Ministry of Culture permits for Machu Picchu and the Inca Trail), our cancellation schedule reflects these obligations:

• Cancellations received 61 days or more prior to arrival: The 40% deposit is forfeited.
• Cancellations received 31 to 60 days prior to arrival: 70% of the total trip cost is forfeited.
• Cancellations received 30 days or less prior to arrival: 100% of the total trip cost is forfeited.

All cancellation requests must be submitted to your dedicated travel concierge in writing via email at info@luxurymachupicchu.org.

3. Comprehensive Travel Insurance

To ensure your complete peace of mind, Luxury Machu Picchu requires that all guests possess comprehensive travel insurance valid for the entire duration of their journey. Your policy should cover trip cancellation, trip interruption, baggage loss, high-altitude medical care, emergency medical evacuation, and repatriation.

4. Itinerary Modifications & Force Majeure

While we meticulously plan every detail of your journey, Peru's geography and occasional external factors mean that unforeseen events (weather conditions, flight or rail schedule adjustments, natural phenomena, civil strikes, or government regulations) may necessitate modifications to your itinerary.

In such instances, Luxury Machu Picchu reserves the right to adjust the routing or substitute accommodations and services with alternatives of equal or superior luxury standard. In cases of Force Majeure, our 24/7 concierge team acts immediately to protect your comfort and safety, though we cannot be held liable for third-party costs arising from events beyond our control.

5. Passports, Visas, and High-Altitude Health Requirements

It is the sole responsibility of the traveler to ensure they possess a valid passport with at least 6 months validity beyond the date of entry into Peru (see our Peru Visa & Entry Requirements Guide). Furthermore, as several signature destinations are located at high elevations—including Cusco (3,399m) and Lake Titicaca (3,812m)—guests should review our Altitude Sickness Prevention Guide and consult their physician prior to departure.

6. Assumption of Risk & Limitation of Liability

Travel inherently involves certain risks, particularly in mountainous or rainforest regions. Luxury Machu Picchu acts as a tour operator and coordinating agent for independent hotel, rail, aviation, and transport suppliers, and assumes no liability for injury, damage, loss, or delay caused by third-party suppliers or events beyond our direct operational control.

7. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Peru. Any dispute arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Cusco, Peru. For any questions regarding these terms, please contact our concierge desk.
